The domain name www.mondanibooks.com and the brand Guido Mondani Editore & Associati S.r.l. are registered by the company Guido Mondani Editore & Associati S.r.l. with registered office in Via Antonio Cantore 42/4, 16149 – Genoa.

These Terms and Conditions of use regulate the use and consultation of the website www.mondanibooks.com and are legally binding between the User (any party using the website) and Guido Mondani Editore & Associati S.r.l.

By continuing to browse the website, the User declares that they have read and accepted the Terms and Conditions provided below regulating the use of the website www.mondanibooks.com. Otherwise they cannot use the above-mentioned website.

2. USER’S RESPONSIBILITIES

The website www.mondanibooks.com is provided in the latest version available, and could contain unknown bugs and/or errors. Therefore, by continuing to browse the website, the user agrees to use the same at their own risk and peril.

The User will hold Guido Mondani Editore e Associati S.r.l. harmless from any damages that may be suffered, and in particular from those caused to its own IT system, by the use of the website.

3. DESCRIPTION OF THE SERVICE

Through the website www.mondanibooks.com Guido Mondani Editore & Associati S.r.l. proposes an online catalogue of books regarding fine watchmaking. These Terms and Conditions regulate the sale and supply of the books by Guido Mondani Editore & Associati S.r.l.

4. PRICES

All the prices of the books sold through the website www.mondanibooks.com s are indicated thereon and include VAT. Instead, they do not include any additional costs which, if applicable, will be viewed by the User before the order is confirmed. Additionally, extra or other taxes, duties or charges imposed by the relative applicable laws are not included in the price either, such as those applicable to imported goods.

If applicable, the User must therefore arrange to clear the imports from customs and pay any duties and charges (other than VAT) that may be due in the receiving country.

Additionally, all costs to which explicit reference is not made in these terms and conditions are not included in the prices.

5. PURCHASE AND DELIVERY

The contract will be considered as having been confirmed when the User sends the order for the products they have selected.

Guido Mondani Editore & Associati S.r.l will arrange to hand over the shipment to the courier appointed for its delivery within 1 working day from the receipt of the order.

Usually orders are delivered within 1 working day from when the goods are handed over to the courier, for shipments to destinations in Italy.

With regard to foreign shipments, the goods are usually delivered within 3/5 working days from the date on which they are handed over to the courier.

6. RIGHT TO WITHDRAWAL

Any User who has made a purchase on the website www.mondanibooks.com in their capacity as a consumer, is entitled to withdraw from the contract signed with Guido Mondani Editore & Associati S.r.l. within fourteen (14) days from the date on which they receive the purchased products.

The User can exercise their right to withdrawal by sending a written communication containing the data relative to the consumer and the order for which the right to withdrawal is being exercised to Guido Mondani Editore & Associati S.r.l., either by registered letter with return receipt of delivery, to the registered office in Via Antonio Cantore 42/4, 16149 – Genoa or by email to the address info@librimondani.it .

The User will be entirely responsible for any shipment costs incurred in order to return the purchased products. These must be returned within 14 days from the date on which the User communicated their intention to exercise the right to withdrawal.

In order to exercise this right, the User must ensure that the goods are integral and perfectly conserved in their original packaging, otherwise their right to withdrawal will be negated.

The returned goods will be accepted by Guido Mondani Editore & Associati S.r.l. provided the book is integral and in its original packaging. Upon receipt of the same, any defects identified therein by Guido Mondani Editore & Associati S.r.l. will constitute a valid reason for negating the User’s right to withdrawal.

The refund will be paid within 3 working days from the date on which the goods are received by Guido Mondani Editore & Associati S.r.l., using the same payment method used by the User to make the purchase.

Any and all matters not regulated herein will be regulated by the provisions of the Italian Civil Code.

7. AMENDMENTS TO THE SERVICE

Guido Mondani Editore & Associati S.r.l. reserves the right to deactivate, or temporarily or permanently suspend all or a single part of the Service.

The User hereby waives any rights to raise claims for compensation for damages which have been or are being suffered as a result of the deactivation or suspension of the Service.

8. LIMITATIONS OF THE LIABILITY OF GUIDO MONDANI EDITORE & ASSOCIATI s.r.l.

The User acknowledges that Guido Mondani Editore & Associati S.r.l can in no way be held liable, and that it will therefore be impossible to formulate any request, for compensation regarding damages that may be suffered or could derive, for example, from:

• The inaccuracy or incompleteness of the books sold on the website mondanibooks.com or the failure of the contents of said volumes to correspond with the truth;
• Delay in shipping the orders received;
• Errors, bugs or viruses that may compromise the device used by the User to browse the website.

9. CUSTOMER’S DUTIES

By using the website, the User undertakes to refrain from performing any abusive, fraudulent and/or unlawful activities. By way of example, the User undertakes to refrain from performing the following actions when using the website:

• Falsifying their personal identity
• Sending any kind of material, or promoting links containing obscene, lewd, fraudulent, defamatory, slanderous, threatening, confidential unlawful or otherwise reprehensible contents.
• Attempting to send any material and/or information that is technically dangerous, including, for example, viruses, Trojans, logic bombs, worms, dangerous components or other tools that could cause the destruction or instability of the medium and the IT system;

• Behave in any way that may constitute a breach of the laws in force.

The User will held responsible for the contents of all contributions or messages sent to Guido Mondani Editore & Associati S.r.l., also through the website www.mondanibooks.com.

10. INFORMATION ABOUT THE REGISTERED MARKS

The brands and service marks, in addition to all the other logos, distinguishing marks, names of products and services are the property of Guido Mondani Editore & Associati S.r.l. with registered office in Via Antonio Cantore 42/4, 16149 in Genoa.

The User undertakes not to use the brands and service marks, or the relative logos, distinguishing marks, names of products and services of Guido Mondani Editore & Associati S.r.l. in any way, without the prior written consent of the latter.

11. LINKS

The website www.mondanibooks.com could contain links or banners which redirect Users to other websites or resources that may also belong to third parties other than Guido Mondani Editore & Associati S.r.l.. The latter declines all liability regarding the connection to said sites linked to www.mondanibooks.com and the relative contents.

For this reason, any User who decides to visit a linked website does so in full autonomy, therefore assuming all responsibility thereto and the duty to exercise all due caution against viruses or other destructive elements. The User also hereby indemnifies Guido Mondani Editore & Associati S.r.l. from any damages that it may suffer, in particular including, for example:

• Damage caused by loss of data;
• Damages caused by malaware and/or spyware;
• Damage caused by the violation of their personal data;
• Any kind of damage caused to their device.

13. JURISDICTION

These Terms and Conditions are regulated by the Italian law. Without prejudice to the enforceability of the mandatory legal provisions, any disputes related to these Terms and Conditions will be subject to the sole jurisdiction of the Court of Genoa.

For any other aspect or dispute not regulated by these Terms and Conditions, please refer to the provisions set forth in the Italian Civil Code.
